EMPLOYMENT LAW

Sometimes it makes sense to hire an attorney to handle employment matters. Even the most conscientious employer occasionally needs help from a lawyer.  Although companies often handle most routine employment matters on their own, some issues are particularly tricky and they require the application of competent legal expertise.  Similarly, employees often do not know where to turn for advice when they have issues with their employers, and competent legal advice is essential to a swift resolution.

Employment law can change rapidly.  Courts and government agencies issue new opinions interpreting these laws every day, sometimes with conflicting results.  When you consider that lawsuits brought by former employees can end in huge damage awards against the employer, it’s easy to see why you should seek legal advice before you get in over your head.

The Law Offices of David G. Concannon, LLC represents companies and individuals in employment and commercial litigation matters, with particular experience in the following areas:

  • Discrimination
  • Labor Law
  • Civil Rights
  • Wrongful Termination
  • Tortious Interference
  • Defamation
  • Breach of Contract
  • Corporate Security
  • Information Management

We have developed particular expertise in the emerging area of workplace issues in the digital age, also known as "Corporate Security and Information Management."  The firm has extensive experience litigating and advising our business clients on issues such as:

  • Workplace privacy in the digital age
  • Who owns data stored on company computers?
  • Are companies responsible for what their employees post on the Internet?
  • What constitutes misappropriation of trade secrets?
  • Theft of company property stored in digital form

As part of the firm’s effort to assist existing and prospective clients in handling these issues, David Concannon and Andy Calvelli developed and teach a seminar entitled "Workplace Privacy in the Digital Age: A Primer for Employers, Employees and Litigators."  This course provides a roadmap to workplace issues in the digital age, including ownership of information, workplace privacy, employer’s right to know, intellectual property and technology rights, methods to protect trade secrets, and computer forensic investigations.

The firm also provides contracts and other employment-related agreements to its business clients.  We review and troubleshoot employment-related agreements, such as employment contracts, confidentiality agreements, non-compete agreements, severance agreements and releases, using our years of experience spent litigating these agreements.  When we draft or review employment-related agreements, we make sure that they contain all the necessary legal terms and will be enforced by a court.  We trouble-shoot and alert our clients to any language that might cause problems later.  Most importantly, we give our clients advice about when to use a particular contracts and when sound business judgment could dictate that a particular agreement should not be used.

Please contact us if you have any questions or if we can assist you.
