TRADE SECRET PROTECTION INFORMATION MANAGEMENT


Information management in the digital age is a perplexing issue facing large and small companies throughout the United States.  For example, on June 19, 2008, the Ninth Circuit Court of Appeals ruled that employee text messaging on company phones is protected by certain privacy laws.  This case, Quon v. Arch Wireless Operating Co., Inc., forces employers to reexamine their policies concerning monitoring their employees' behavior on the job. 

The Quon case highlights an emerging area of the law known as corporate security and information management in the digital age.  Where is the line between "company time" and "employee time" in the digital age?  Can companies be held responsible for personal acts committed by the ir employees on company time?  Few law firms are equipped to handle these emerging issues of employement law in the digital age.  However, the Law Offices of David G. Concannon, LLC has been ahead of this curve for several years. 

The firm has extensive experience litigating and advising our business clients on issues such as:

As part of the firm’s effort to assist existing and prospective clients in handling these issues, the firm developed and teaches a seminar entitled "Workplace Privacy in the Digital Age: A Primer for Employers, Employees and Litigators."  This course provides a roadmap to workplace issues in the digital age, including ownership of information, workplace privacy, employer’s right to know, intellectual property and technology rights, methods to protect trade secrets, and computer forensic investigations.  In addition, David Concannon teaches an ongoing continuing legal education course on computer forensic investigations, uncovering electronically stored information and the use of digital information in the courtroom.
